Medicaid Nursing Home Denial: How to Identify the Issue in the Notice
A Medicaid denial can result from very different problems.
Before appealing, identify the category of denial and the specific rule or evidence the state says was not satisfied.
Common denial categories
- income/resource eligibility;
- nursing-facility level of care;
- missing verification;
- transfer-of-assets penalty;
- home-equity/resource issue;
- residency/citizenship requirement;
- trust/annuity treatment;
- procedural deadline; or
- another state-specific reason.
Read the notice for the legal/factual basis
Ask:
“Which eligibility requirement does the state say is not met?”
Then find:
- facts used;
- amount/value calculated;
- assessment score or criterion;
- transfer date/value;
- missing document;
- effective date; and
- fair-hearing deadline.
Correct factual errors first
Examples:
- bank account belonged to someone else;
- property already sold;
- income entered twice;
- spouse allocation missing;
- clinical assessment used outdated function;
- document was submitted but not matched to case.
Build evidence around the actual error.
Do not move assets after a denial without advice
A denial based on resources/transfers can tempt families to “fix” the case quickly.
That can make the problem worse.
Get qualified legal/benefits advice before additional transfers.

Frequently asked questions
Can the nursing home appeal for the resident?
Only if properly authorized under the state process.
What if the denial reason is unclear?
Request clarification and the case record if available.
Can a hearing officer consider new evidence?
State procedures vary; review the hearing instructions and legal advice when needed.
The practical goal
A useful appeal is not “Medicaid should pay.”
It is:
the state denied for X; the relevant rule/fact is Y; the evidence shows Z.
