Paying Assisted-Living Rent During a Hospital Stay: What to Check
When an assisted-living resident goes to the hospital, families may expect the monthly bill to stop because the resident is not sleeping in the apartment.
Often, the unit is still being held under the resident agreement.
Review the assisted-living contract and state rules separately from federal nursing-home bed-hold protections.
Read the absence/hospitalization clause
Look for:
- whether base rent continues;
- whether care fees continue;
- meal credits;
- supply charges;
- room-retention rules;
- notice/cancellation terms;
- length-of-absence provisions; and
- return assessment requirements.
Do not assume the entire monthly charge should disappear.
Separate housing from care
The apartment may remain reserved even if hands-on care is not being provided in the community.
Ask the billing office to separate:
Housing/base: ______
Care-level fee: ______
Medication service: ______
Meals: ______
Other: ______
Then ask what the contract says for each component during hospitalization.
Ask whether a return assessment is required
A hospital stay can change mobility, medication, cognition, or nursing needs.
Before returning, ask whether the community must reassess the resident and whether a higher or different care plan could change the price.
Do not apply nursing-home federal bed-hold rules automatically
Medicare/Medicaid-certified nursing facilities have specific federal transfer, bed-hold notification, and readmission protections.
Assisted living is primarily regulated by states and resident agreements.
Use the correct rule set.
Ask what happens if the resident cannot return
If the community later determines it cannot meet the resident’s changed needs, ask about:
- notice;
- charges during notice period;
- refund of prepaid amounts;
- belongings;
- transition assistance; and
- state move-out rules.

Frequently asked questions
Should we stop autopay while hospitalized?
Do not create a default/payment problem without first reviewing what is actually owed and contacting the business office.
Does Medicare pay assisted-living rent while someone is hospitalized?
Medicare generally does not pay assisted-living room and board.
Can the community charge for care not provided?
Contract terms and state rules matter. Ask for the line-item basis rather than assuming.
The practical goal
During hospitalization, separate reserved housing, actual care, and state/contract obligations.
That makes the bill review much clearer.
